Manucurist x The Bradery

 

Article 1 – Definition and conditions of the competition

The company SYMMETRICS, a Société par Actions Simplifiée with its registered office at 25 rue du Mail 75002 PARIS, registered under number 83944225800027 (hereinafter "the Organiser, the Organising Company, the Organisers, the Professional") is organising a prize draw as part of a marketing campaign

MANUCURIST (hereinafter "the Organising Company"), a société par actions simplifiée, registered under SIREN 813646429 located in PARIS (75010) is organising from 05/04/2023 to 12/04/2023 inclusive, a competition comprising 1 gift voucher of €200 to be spent on the website and mobile application www.thebradery.com and 1 gift voucher of €200 to be spent on munucurist.fr.

The "Participants" in the competition are also referred to hereinafter as "the Participants, the Users, the Contributors, the Players". The "Winners" of the draw are also referred to hereinafter as the "Winners".

Article 2 – Conditions of participation

This competition is open to any natural person, of legal age, residing in metropolitan France, upon acceptance of the conditions of participation in accordance with the Data Protection Act. Only one entry per natural person is accepted throughout the duration of the Competition. Employees of SYMMETRICS and MANUCURIST, as well as members of their families, are excluded from participation in the competition. 

Also excluded are all persons already subscribed to the Manucurist newsletter before the start date of the competition.

 

Article 3 – Competition dates from 5 to 12 February inclusive 2023

Contest start date: 5 April 2023 at 10:00

Competition end date: 12 April 2023 at 16:00

Draw date: 12 April 2023

Date of Winners' designation: 12 April 2023

 

Article 4 – Terms of participation

4.1) Entry conditions

To register for the draw and attempt to win the prize set out in article 5, each participant must have completed the actions listed below:

  • Subscribe to the www.thebradery.com newsletter and tick the box authorising the receipt of partner offers.

OR

  • Subscribe to the manucurist.fr newsletter and tick the box authorising the receipt of partner offers.

Registration for the draw is only effective upon completion of these steps.

Participation in the competition will only be valid if the information required by SYMMETRICS & MANUCURIST is complete and correct. Any registration made using incorrect, falsified information or via counterfeit or falsified forms will automatically forfeit all rights to obtain any winning prize.

Each participant therefore undertakes to disclose accurate information about themselves. SYMMETRICS & MANUCURIST disclaim all liability in the event that a participant uses false surnames and/or first names associated with a valid email address or a false email address.

 4.2) Guarantees and liability regarding the validity of entries

SYMMETRICS and MANUCURIST reserve the right to cancel, end or modify this promotion if it does not proceed as planned: any virus, bug, breach, unauthorised intervention, fraud, action by a competitor, technical problem or any other cause beyond the control of SYMMETRICS and MANUCURIST that alters and affects the administration, security, fairness, integrity, or conduct of the competition.

In general, Participants guarantee the Organisers of this competition against all recourse, actions or claims that any third parties may bring, on any grounds whatsoever, under all warranties and commitments made.

Any incomplete or incorrect entry will be rejected, without the Organisers being held liable.

Every participant undertakes to comply with the rules. Any failure to comply with the rules by the Participant and any fraud, abuse, cheating or false declaration will result in their exclusion from the competition without the Organisers being held liable.

Accordingly, the Organising Companies reserve the right without reservation to moderate after the fact and to refuse to validate, or even exclude and remove from the competition, any participant who does not comply with one of the conditions of these rules.

Furthermore, in the event of abuse or cheating by one or more participants, SYMMETRICS and MANUCURIST reserve the right to modify or end the competition without notice, particularly when the integrity of the competition is called into question.

4.3) Draw procedure

The winner will be determined by a draw to be carried out, on the date mentioned above, from the database of registered persons meeting the conditions mentioned above. 

1 (one) participant will be drawn by lot by the company SYMMETRICS.

 

Article 5 – Prizes/Lots

5.1) Commercial value of prizes

Prize 1 is offered by the company SYMMETRICS and constitutes as such a "prize award". 

The designated prize is as follows: 1 gift voucher of €200 to be used on the website and mobile application www.thebradery.com valid until 30/07/2023.

– Promotional codes cannot be combined with each other 

Prize 2 is offered by the company MANUCURIST and constitutes as such a "prize award". 

The designated prize is as follows: 1 gift voucher of €200 to be used on manucurist.fr. Gift vouchers cannot be combined with other ongoing promotional offers or with gift vouchers linked to the loyalty programme.

 5.2) Terms of redemption, use and renewal

As provided for in article 6, the winner must get in direct contact with SYMMETRICS and MANUCURIST and comply with the defined terms of use.

The prizes offered cannot give rise to any dispute regarding their nature or to the provision of any form of consideration whatsoever.

 

Article 6 – Prize award terms

SYMMETRICS will award one (1) prize to one (1) Winner and MANUCURIST will award one (1) prize to one (1) Winner. There will therefore be one (1) prize from SYMMETRICS and MANUCURIST for one (1) natural person.

Once the Winners have been designated by SYMMETRICS and MANUCURIST, they will be contacted via the email address used when entering the competition.

All email exchanges between the Organiser and the Winners will be retained in the Professional's email inbox.

Winners will be invited by return email to provide their precise contact details (surname, first name, email address) in order to receive the prize won. 

If the information provided by the Participant is incomplete and/or does not allow them to be notified of their prize, they will lose their status as a Winner and will not be able to make any claim.

The Organiser shall not be held liable in the event of technical failures regarding this electronic prize notification. Without communication of this information by the Winners within 10 days, they will lose their status as a Winner.

If applicable, a second draw will take place.

 

Article 7 – Terms of use 

MANUCURIST: *Gift vouchers cannot be combined with other ongoing promotional offers or with gift vouchers linked to the loyalty programme. Gift voucher valid until 30/07/2023 inclusive.

THE BRADERY: Gift vouchers cannot be combined with each other. Gift voucher valid until 30/07/2023 inclusive.

 

Article 8 – Personal and nominative data

Players authorise in advance, by the mere fact of their participation, the Organisers to freely use for advertising or promotional purposes, on any medium whatsoever, all personal information communicated on their behalf and across all platforms.

The personal data collected about you is mandatory and necessary for the processing of your participation in the game. It is intended for the Organisers, or for subcontractors and/or service providers for management purposes.

In accordance with applicable regulations, the information collected is intended exclusively for the Organisers and will not be sold or transferred to third parties in any manner whatsoever.

The information provided by the Participant is intended for use by SYMMETRICS and MANUCURIST in the context of access to their service in accordance with the general terms and conditions of sale and in the context of the management of this game.

Any person is deemed to have read, understood and accepted, without reservation, the rules in their entirety, and in particular the article relating to personal data, from the moment they access and register for the competition.

 

Article 9 – Liabilities and rights

The Organisers:

  • Reserve the right to modify, extend, shorten, limit the prizes or cancel this game in the event of force majeure as defined by case law. Consequently, their liability may not be engaged on this basis.
  • Shall not be held responsible for the fraudulent use of connection rights or the award of a Participant's prize.
  • Disclaim all liability in the event of malfunction of the internet network, telephone lines, or reception equipment preventing the proper running of the game. Furthermore, their liability shall in no case be held for problems with the routing or loss of electronic or postal mail.
  • Disclaim all liability in the event of technical, material or software failure of any kind (virus, bug, etc.) caused on the Participant's system, to their computer equipment and the data stored therein, and to the consequences that may result for their personal, professional or commercial activity.

Participants:

  • Are held responsible for the accuracy of the information transmitted to the Organisers

 

Article 10 – Exclusion conditions

Participation in the game implies full and complete acceptance of the terms set out in these rules without any reservation or prior condition on the part of the Participant; failure to comply with said rules will result in exclusion from the competition, the outright nullity of their participation and the award of prizes.

 

Article 11 – Filing of the rules

All documents are made available and accessible in French to any user and Participant for the duration of the game. They are asked to make a backup copy and/or print all texts in order to be able to refer to them, if necessary.

 

Article 12 – Participation costs

The competition is free to enter and requires no purchase.

 

Article 13 – Competent jurisdictions

These rules are governed by French law.

In the event of a dispute or complaint regarding the competition for any reason whatsoever, requests must be addressed in writing to the attention of SYMMETRICS or MANUCURIST by post to the address mentioned in the preamble, during the competition period and within a maximum of sixty (60) days after the designation of the Winner.

In the event of a dispute or complaint regarding the prize awarded, requests must be addressed to: 

  • To the attention of Customer Services by email at hello@thebradery.com. within seven (7) days of receiving confirmation of the prize;

 OR 

  • To the attention of MANUCURIST by email at hello@manucurist.com within seven (7) days of receiving confirmation of the prize. 

The parties shall endeavour to resolve amicably any dispute arising from the interpretation or execution of these rules. If the disagreement persists, it shall be submitted to the competent courts.

The Participant acknowledges having read these rules, accepts them without reservation and undertakes to comply with them.
