Rules of the The Bradery x Happn 2025 Competition

COMPETITION RULES THE BRADERY X HAPPN 

From 14 January to 17 January 2025

Article 1: Organisers

Organiser 1: Société Happn, (hereinafter "Organising Company 1"), SAS, a simplified joint-stock company under French law registered with the National Business Register (RNE), with a share capital of €38,885.80 (fixed), whose registered office is located at 5-7 5 RUE FEYDEAU 75002 PARIS,

Organiser 2: Société SYMMETRIC (hereinafter "Organising Company 2"), a simplified joint-stock company with a share capital of €1,338.90, whose registered office is at 23 rue du Mail, 75002 Paris, registered with the Nanterre Trade and Companies Register under number 839 442 258.

Organise on The Bradery website and app as well as on the Happn app, from 15 January to 17 January 2025 inclusive (Paris dates and times) a free Game with no purchase obligation entitled « Happn x The Bradery Competition » (hereinafter referred to as the "the Game"), in accordance with the terms described in these rules.

Article 2: Terms of Participation

This free Game is open to any individual aged 18 or over with internet access, with the exception of staff of the Organising Companies and their families, as well as any persons who have collaborated in the development of the Game.

Only one entry per person is accepted (same surname, same first name, same date of birth, same e-mail address and same postal address). Winners will be required to provide proof of their age before receiving their prize.

Participation in the Game implies express and unreserved acceptance of the Rules in all its stipulations and provisions, the rules of ethics in force on the Internet (etiquette, code of good conduct, etc.…), as well as the laws and regulations in force in France.

The Organising Companies reserve the right to automatically cancel participation in the Game if these conditions are not met.

Participation is strictly personal and the participant may under no circumstances play under multiple usernames or on behalf of other participants. The Organising Companies reserve the right to ask any participant to provide proof of these conditions. Any person who does not meet these conditions or refuses to provide proof will be excluded from the Game and will not be able, in the event of a win, to take possession of the prize.

Anyone wishing to participate in the Game must provide the Organising Companies with their e-mail address. If the participant ticks the box "I agree to receive The Bradery Newsletter by e-mail", they will receive a confirmation email containing a clickable link allowing them to unsubscribe.

To participate in the Game, participants simply need to:

- Log in to the Game page, fill in the registration form by completing the mandatory fields as defined above, then click on "I'm entering" to confirm your registration.

Article 3: Game Announcement Methods

This Game is announced by The Bradery x Happn through the following communication channels:

- The Bradery website and app ;

- The Bradery social media (Instagram) ;

- The Bradery commercial emails ;

- The Happn app

Article 4: Methods of Selecting the Winner and Awarding the Prize

The 10 winners will be notified individually by e-mail on 20 January 2025. If a winner does not come forward within fifteen (15) days of the announcement of the results by email, they will be deemed to have waived their prize and a new draw will be held to select a new winner.

Article 5: Prize Pool

The prize pool consists of ten (10) gift cards worth €100 each, valid for 1 month on The Bradery website and app, and ten (10) Happn Premium subscriptions for ten (10) winners. 

Article 6: Verification of Participants' Identity

Participants authorise any verification concerning their identity and place of residence.

These verifications will be carried out in strict compliance with the legal provisions concerning the protection of privacy. Any falsified, fraudulent, false, misleading, incorrect or inaccurate identity or address information may result in the disqualification of the participation.

Article 7: Liability

The Organising Companies will not be held liable in the event of malfunction affecting the smooth running of the Game or in the event of a malfunction of the "Internet" network or the Instagram social network preventing access to the Game or its smooth running. Even if the Organising Companies make every effort to provide users with available and verified information and/or tools, they cannot however be held liable for errors (including display errors on Game sites, incorrect emails), unavailability of information and/or the presence of viruses on the site. Participation in this Game implies knowledge and acceptance of the characteristics and limitations of the Internet, the lack of protection of certain data against potential misappropriation or hacking, and the risks of contamination by potential viruses circulating on the network.

It is the responsibility of each participant to take all appropriate measures to protect their own data and/or software stored on their computing and telephone equipment against any breach.

Any person's connection to the site and participation in the Game is entirely at their own risk. Furthermore, the Organising Companies are not liable in the event :

- telephone connection issues,

- hardware or software issues,

- destruction of information provided by participants for a reason not attributable to the Organising Companies,

- human or electrical errors,

- disruptions that could affect the smooth running of the Game or malfunctions of the automated draw process.

The Organising Companies cannot be held liable for the winner's inability to board a plane or travel to a foreign country due to irregular documentation (lack of visa, lack of passport or expired passport, etc.) or health restrictions. In all cases, if the smooth administrative and/or technical running of the Game is disrupted by a cause beyond the control of the Organising Companies, they reserve the right to suspend the Game.

Any fraud or failure to comply with these rules may result in the exclusion of the offender from the Game, with the Organising Companies reserving the right, where applicable, to take legal proceedings against them.

Article 8: Modification of Game Dates

The Organising Companies shall not incur any liability if, in the event of force majeure or circumstances beyond their control, they are required to cancel this Game, reduce it, extend it, to postpone it or modify its conditions.

The Organising Companies reserve the right to extend, reduce or postpone the Game's duration dates.

Article 9: Interpretation of the Rules

The Organising Companies will settle any question and/or dispute relating to the application of these rules, in compliance with French legislation. These decisions will be final.

Any dispute or complaint relating to this Game must be submitted in writing and sent to the Game's address: hello@thebradery.com. 

Article 10: Applicable Law and Jurisdiction

These rules are governed by French law, to the exclusion of its rules of private international law.

Article 11: Reimbursement

The Game is entirely free of charge and cannot be subject to any reimbursement.

Participants who access the site via a modem and a telephone line billed on a per-minute or per-call basis may obtain reimbursement of their connection costs on the website www.airfrance.com on the basis of a daily flat rate corresponding to the cost of a 6 (six) minute local telephone call (VAT inclusive) from a landline.

Expenses incurred (current slow-rate stamp) by the participant for this request will be reimbursed upon simple request. Only one request per participant (same name, same address and/or same e-mail and/or same bank account details) will be taken into account throughout the Game. It being noted that in the current state of service offerings and technology, certain Internet service providers offer free or flat-rate connections to users, it is expressly agreed that any access to the Game site on a free or flat-rate basis (such as in particular connection by cable, ADSL or dedicated line) shall not give rise to any reimbursement, insofar as the subscription to the services of the access provider is in this case contracted by the user for their general use of the Internet and the fact that the participant connects to the Game site and participates in the Game does not incur any additional costs or expenses.

Likewise, any reimbursement request must be made no later than ten (10) calendar days after receipt of the corresponding telephone invoice. The date used will be the one shown on the invoice. The reimbursement request must include the following: the participant's surname, first name, postal address and e-mail address (all of these must be identical to those entered on the Game registration form), a RIB or RIP (bank or postal account details), the date and time of their participations, their e-mail address and password, and as soon as available, a photocopy of the detailed invoice from the telephone operator and/or internet service provider showing the connection dates and times with these underlined.

This photocopy will serve as proof of address. The name and address of the person requesting the reimbursement must be the same as those mentioned on the telephone operator's invoice. Each reimbursement request containing the information and documents described above must be sent to:

Article 12: Acceptance of the Rules

Participation in this Game entails full and unreserved acceptance of all clauses and conditions of these rules.

Article 13: Processing of Personal Data

In accordance with the applicable regulations on the protection of personal data, and in particular the provisions of the French Data Protection Act ("loi Informatique et Libertés") of 6 January 1978 as amended, and the General Data Protection Regulation (EU Regulation 2016/679), Organising Company 2, as data controller, informs you that the information collected in the context of the Game is subject to personal data processing.

For information indicated as mandatory, it is necessary for participation in the Game. In the absence of such data, participation cannot be taken into account.

For information not indicated as mandatory, as the legal basis for processing is your consent, you have the right to withdraw your consent at any time. Data is retained for the duration of the Game and for a period of three (3) years from the date of prize distribution. Data is intended for the services of the Organising Company responsible for the Game, as well as for the subcontractors to whom the Organising Company calls upon for the implementation of the processing.

In accordance with applicable regulations, the participant has the right of access, rectification, objection, portability, restriction of processing and erasure of personal data concerning them. These rights may be exercised directly with The Bradery's data protection officer, in writing at hello@thebradery.com, making sure to specify that the request is made in the context of the Game.

The participant is informed that any exercise of the right to erasure before the end of the Game will result in the immediate cancellation of their participation.

The participant also has the right to contact the French National Commission for Information Technology and Civil Liberties (CNIL) with any complaint relating to the way in which the Organising Companies collect and process personal data in the context hereof.
