2024 Advent Calendar Rules

Article 1: Game organising companies

 

The company SYMMETRIC (hereinafter, "Organising Company 1"), a simplified joint-stock company with share capital of €1,338.90, whose registered office is located at 111, avenue Achille Perreti, registered with the Nanterre Trade and Companies Register under number 839 442 258. 

 

SYMMETRIC is organising a free game with no purchase obligation entitled "Christmas Competition" (hereinafter, the "Game") from 01/12/2024 at 3 pm to 24/12/2024 at midnight (hereinafter, the "Game Period"), accessible on The Bradery app.

Article 2: Consultation of the game rules

 

The full Rules of the Game (hereinafter, the "Rules") are available free of charge on the Website throughout the entire Game Period.

 

It is also available free of charge to any person who requests it from the Organising Companies at the following addresses: hello@thebradery.com.

 

Article 3: Participation

 

Participating in the Game implies unreserved acceptance of and compliance with the provisions of the Rules.

 

The Game is not managed or sponsored by Facebook. The information you provide is supplied to and used solely by the Organising Company, and not by Facebook.

By participating in the game, you accept the data protection policy and agree to receive newsletters from The Bradery. 

 

    3.1 Conditions for participation in the Game

 

Only natural persons residing in metropolitan France may participate in the Game, excluding staff of the Organising Company and those of companies that have participated in the preparation of the Game, and members of their immediate families (parents, brothers and sisters, or any other person residing in the same household). 

 

Any participant under the age of 18 and/or lacking legal capacity must obtain prior authorisation from a parent or guardian to participate in the Game and accept the Rules. 

The Organising Company may at any time request any minor or assisted participant to provide proof of such authorisation and, where applicable, disqualify a participant who is unable to provide such proof. Participation in the Game is limited to one person per entry (same surname, same first name, same email address and Facebook account), except for sharing the Game as indicated in clause 4.2. Any additional entry will be considered null and void.

 

To participate, it is mandatory to use a valid personal email address.

 

    3.2 Validity of entry

 

The Organising Company reserves the right to verify that participants have taken part in the Game in accordance with the Rules. Non-compliant entries will result in the disqualification of participants and the loss of points. 

 

The following situations will result in the immediate disqualification of participants: 

  • Multiple entries using non-existent email addresses. 

 

The Organising Company may cancel all or part of the Game if it becomes apparent that fraud of any kind has occurred, including by electronic means, in connection with participation in the Game. In such a case, it reserves the right not to award prizes to those who have committed fraud and/or to pursue the perpetrators of such fraud before the competent courts.

 

It is expressly agreed that the Organising Company may rely on programs, data, files, records, transactions and other elements in digital or electronic format or storage, in particular for the purpose of proving any breach by participants of the provisions of the Rules.

 

Article 4: How the game works

 

    4.1. In order to validate their entry, participants must provide their email address, accept the participation conditions, and confirm their entry.

 

    4.2. In order to participate in the Game, participants must, during the Game Period, proceed as follows:

- Go to the The Bradery app

- Enter their email address

- Click on "I'M ENTERING"

- Each day, one winner is drawn at random during the 24 days of the game period and contacted by email. 

- Purchase vouchers won after participating on consecutive days will be sent by email on 26 December.

- Any inaccurate or incomplete entry cannot be taken into account and may result in the entry being declared null and void. In particular, entries with inaccurate, fictitious or incomplete contact details, or those that do not comply with the provisions of the Rules, or those submitted after the close of the Game Period, may not be taken into consideration.

It is strictly forbidden for a participant to enter the Game using another person's email address or a fake email address.

    5.2. Prizes may not be exchanged or converted into their cash equivalent, and may not be awarded in any form other than that provided for in the Rules.

 

Article 6: Prize Delivery

  • If your total score is less than 7 points, you will not receive any purchase voucher.
  • If your total score is between 7 and 14 points, you will receive a unique free delivery code, valid from €60 of purchases and for all shipping costs under €10 in metropolitan France, Belgium and Luxembourg only.
  • If your total score is between 15 and 21 points, you will receive a €15 purchase voucher, usable on all collections except Travel, from €60 of purchases.
  • If your total score is 24 points or more, you will receive a €30 purchase voucher, usable on all collections except Travel, from €80 of purchases.
All purchase vouchers will be sent to you by email on 26 December at the email address you used to participate.
Your code is unique, usable only once and linked to your email address.
You have until 31 January 2025 to use it.
For any claim, we will need your email address and a screenshot of your score on the app.
You must be subscribed to the newsletter in order to receive your purchase voucher.

 

Any prize that cannot be delivered due to an error or omission in the participants' contact details, a change in their contact details or an unsubscription from The Bradery newsletter, due to failure to claim the prize within the allotted timeframe or for any other reason attributable to the winners, and any prize not claimed by the winners within the allotted timeframe, shall be deemed forfeited and will not be re-entered into the draw. The prize may under no circumstances be claimed at a later date by the original winner.

 

Article 7: Data Protection

 

    7.1. Personal data relating to participants in the Game is intended for use by the Organising Company for the purposes of the Game, in particular its organisation, the generation of participation statistics, the processing of participants' entries and the dispatch of prizes.

 

Personal data whose provision is mandatory in the context of the Game is identified by an asterisk on the Game's entry form; failure to provide this mandatory information will mean the participant's entry cannot be taken into account.

 

    7.2. Under no circumstances shall this information be retained after the Game ends, unless the participant consents to receiving commercial offers relating to the products and services of the Organising Company.

 

Pursuant to Act No. 78-17 of 6 January 1978 on data processing, data files and individual liberties, participants and their legal representatives have the right to access, rectify and delete data concerning participants, as well as the right to object on legitimate grounds and to object to prospecting, including for commercial purposes.

 

7.3. Through this game, each participant who clicked on "I'M ENTERING" on the registration form will receive from Organising Company 1 and 2 emails about news, offers and brand updates. Article 8: Liability

 

    8.1. Participating in the Game via the Internet implies knowledge and acceptance of the characteristics and limitations of the Internet, particularly with regard to technical performance and response times for consulting, querying or transferring information. The absence of protection of certain data against potential misuse and the risks of contamination by viruses circulating on the network cannot under any circumstances result in the liability of the Organising Company being engaged.

 

As such, the Organising Company shall not be held liable in the event of an interruption to Internet communications or alteration of entries (network communication, network interruption) and more generally, for any malfunction of the Internet network, all or part of the Website or any other technical connection over which the Organising Company has no control. In particular, the Organising Company or its service providers accept no liability in the event that the Website is unavailable during the Game Period for a reason not attributable to them.

 

Likewise, the Organising Company cannot be held liable for delays or errors in the transmission of electronic mail that are beyond its control, and accepts no liability in the event of misuse of the device used to access the Game or of any incident related to the use of such device (in particular, the Organising Company shall not be held liable for any material or immaterial damage caused to participants, their IT equipment and the data stored thereon, and the consequences that may result for their personal, professional or commercial activities).

 

    8.2. The Organising Company shall not be held liable in the event of an error in the delivery of the prize due to incorrect information provided by the winner.

 

    8.3. The Organising Company shall not incur any liability if, in the event of force majeure, it is required to cancel, shorten, extend, postpone or modify the conditions of this Game, and its liability cannot be engaged as a result.

 

 

Article 9: Reimbursement of internet connection costs

 

No financial consideration or expenditure of any kind whatsoever shall be granted to participants in connection with their participation.

 

 

Article 10: Intellectual Property / Right of Image

 

The images used on the Website, the objects depicted, the brands and trade names mentioned, the graphic and digital elements and the databases making up the Website are the exclusive property of their respective owners and may not be extracted, reproduced, represented or exploited without their prior written authorisation, on pain of civil and/or criminal proceedings.

 

All brands or product names mentioned are registered trademarks or product names of their respective owners.

 

 

Article 11: Disputes - Applicable law

 

The Game and the Rules are governed by French law, without prejudice to mandatory public policy provisions applicable in the participant's country of residence.

 

Any dispute arising in connection with this Game shall be submitted to the competent French courts, without prejudice to mandatory public policy provisions applicable in the participant's country of residence.
